Terms and Conditions of Prize Draw Entry

Summary of Terms and Conditions:
This Prize Draw is only open to Property Week subscribers who are UK residents (excluding Northern Ireland), aged between 30 and 70, who hold a full valid UK driving licence and who have provided their contact details via the Energy Efficiency Survey.
Starts: 7 January 2019 09.00 Closes: 25 January 2019 23.59. No purchase necessary.
Terms and Conditions
1. Definitions
1.1 The following terms have these meanings:
“Data Controller” means as defined in the GDPR;
“GDPR” means the EU General Data Protection Regulation (Regulation (EU) 2016/679), as amended;
“Personal Data” means as defined in the GDPR;
“Privacy Notice” means the Promotor’s privacy notice which sets out:
• where we might get data about you from;
• why we need it;
• what we might do with the data (including who we might share it with);
• the circumstances in which your data might be transferred abroad; and
• how long we keep it for.
“Process” “Processed” means as defined in the GDPR; and
“Promoter” means E.ON Energy Solutions Ltd Registered office Westwood Way, Westwood Business Park, Coventry CV4 8LG. Registered in England and Wales No. 3407430.
2. To enter this Prize Draw you must:
a) be a resident of the UK (excluding Northern Ireland);
b) be aged between 30 and 70;
c) be a Property Week subscriber when this Prize Draw closes on 25 January 2018 23.59;
d) be in reasonable health;
e) hold a full valid UK driving licence; and
f) have provided your name, email address and phone number via the Energy Efficiency Survey (click here for a link to the survey).
3. Prize Draw begins: 09.00 7 January 2019

5. To enter:
5.1
a. Provided you have opted to receive marketing from Property Week, you will receive an email from Property Week titled ”Give us your views on the value of energy efficiency in real estate”. In this email there will be a link to a survey being commissioned jointly by Property Week and the Promoter (the ”Link”). b. Click on the Link and complete the survey. Once you complete the survey, should you wish to enter into this Prize Draw, you will need to give us your name, contact telephone number and email address and confirm you wish to be entered into this Prize Draw. Entries which are incomplete, misspelt, or incomprehensible are void and will not be entered into this Prize Draw.
5.2 The Promotor shall not be responsible for the non-inclusion of entries into this Prize Draw as a result of technical failures or otherwise. Proof of submission of the survey is not proof of receipt of entry.
5.3 You may only submit one entry to this Prize Draw. If you complete the survey more than once, you will still only have entered this Prize Draw once.
5.4 Purchase is not necessary to enter this Prize Draw, but internet access is required. Costs to enter the Prize draw via the internet may vary, please check with your service provider for current charges.
6. Selection of the winner
6.1 There will be one winner of this Prize Draw.
6.2 The winner of this Prize Draw will be randomly selected from all entries correctly submitted in accordance with these Terms and Conditions.
6.3. The winner will be selected at random within 5 working days of the closing date of this Prize Draw.
6.4. Winner will be contacted by email and/or a telephone call within 10 working days of this Prize Draw closing. All entrants must ensure that their contact details are up-to-date and correct before entering this Prize Draw.
6.5. If a winner doesn’t respond to claim their Prize within 5 working days of being contacted, the Promotor reserves the right to pick another winner.
6.6. You acknowledge that you may be required to be used in publicity if you are selected as a winner.
7. Prize information:
7.1 The Prize is a One Day on Road Tesla Model S 85 Supercar Experience (”Experience”) provided by Virgin Experience Days (”Virgin”). As part of the Experience, you will have use of the vehicle for 24 hours and with no mileage restrictions.
7.2 When redeeming the Prize the winner and any accompanying guests agree to abide by the full terms and conditions of Virgin Experience Days which can be found at https://www.virginexperiencedays.co.uk/one-day-on-road-tesla-supercar-experience?_sm_au_=iVVSPS0QVNFwtRf5
7.3. If you’re the winner of this Prize Draw, you agree that the Promotor can use your name and county of residence to announce the winner.
7.4. The name of the winner can be obtained by emailing Claire.Mitchell@eon-uk.com up to 6 weeks after the closing date of this Prize Draw.
7.5. The Promoter has the right to cancel or change this Prize Draw at any time.
7.6. If Prizes aren’t available for any reason, the Promotor reserves the right to offer an alternative Prize of similar financial value. There is no cash or credit alternative.
7.7 The Prize is non-transferable, non-negotiable and excludes any additional costs and expenses.
7.8 If you are the winner, you will be issued with a voucher for the Experience which must be redeemed within 9 months of issue. When you are issued with a voucher for the Experience, you will also receive instructions on how to book your Experience.
7.9 You will not be able to take part in the Experience if you have been previously convicted of one of the following:
AC: Accident offence
BA: Disqualified
CD: Careless Driving
DD: Reckless/Dangerous Driving
DR: Drink or Drugs
IN: Insurance Offence
TT99: Disqualification due to maximum penalty points
7.10 In order to participate in the Experience, you must produce a full valid UK driving licence on the day you book your Experience – photocopies will not be accepted.
7.11 In order to participate in the Experience, you will need to provide a credit or debit card for a £500 deposit - payment will be taken approximately 2 days prior to your Experience day. This deposit will be refunded to you within 5 working days of you returning the car to Virgin without damage.
7.12 If you are deemed to be under the influence of alcohol or drugs, you will not be permitted to participate in the Experience.
7.13 You may not take the car outside mainland UK during your drive
7.14 The car is fully insured for one driver, however if you wish for an additional driver to be added a fee of £70 will need to be paid at the time of arrival to collect the car.
7.15 The car must be returned to Virgin at the specified time. Any late returns will incur a charge.
7.16 Friends and Family are welcome but please be aware that there are no viewing facilities on site. Up to three guests can join you as passengers in the car.
7.17 The Experience is available for bookings Monday to Friday with collection and returns from 09.00 to 16.00. Note, date restrictions may apply.
7.18 Virgin recommend you book your Experience at least four weeks in advance to ensure that dates are available. All bookings are subject to availability.
7.19 You will not be liable for accidental damage to equipment, except where damage has been caused as a result of recklessness or wilful negligence. A cancellation indemnity, subject to terms, is included with every voucher.
8. General
8.1 The winners is responsible for all applicable taxes and expenses not specified in the description of the Prize above.
8.2. If you provide any Personal Data under these Terms and Conditions, E.ON UK plc will be the ‘Data Controller’. The Promotor’s Data Protection Officer can be contacted at Newstead Court, Little Oak Drive, Annesley, Nottinghamshire, NG15 0DR. The Promotor will Process your Personal Data in accordance with its Privacy Notice, as amended from time to time, which can be found at www.eonenergy.com/privacy or by contacting the Promotor to request a paper copy. Notwithstanding the Privacy Notice, by entering this Prize Draw you hereby agree to Property Week collecting the Personal Data you provide when you complete the survey (as set out in paragraph 5.2) and passing this to the Promoter for the purposes of the Promoter administering this Prize Draw.
8.3. Subject to paragraph 8.4 the Promotor cannot accept any responsibility for any damage, loss or injury suffered by any entrant participating in this Prize Draw and/or the Experience.
8.4 Nothing in these Terms and Conditions will limit the Promotor’s liability for death or personal injury caused by its negligence or for fraud.
8.5 By entering this Prize Draw, all participants shall be deemed to have accepted these Terms and Conditions.
8.6 In the event of a discrepancy between these Terms and Conditions and the details in any promotional material, these Terms and Conditions shall prevail.
8.7 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes shall be subject to the exclusive jurisdiction of the English Courts.
