Court deposit decisions

Question: I was unable to complete a property purchase because of difficulties arranging finance. The contract excludes section 49(2) of the Law of Property Act 1925. I paid the seller a deposit on exchange. Can I get this back? Aruna Sarwar, associate at Lewis Silkin, responds
