Last night ministers were embroiled in a row with the RICS about disputed terms of a deal struck less than an hour before the U-turn was announced.
Communities secretary Ruth Kelly suggested to MPs the threat of a legal challenge had vanished. 'The issue of the judicial review is now resolved,' she said.
But RICS rejected this. It said the review had only been stayed and could be reactivated at any time, and that it had 'not agreed to what the minister outlined to parliament'.
